These Terms of Service ("Terms") govern your use of madebyvelocity.com (the "site"). Made by Velocity is a brand of QStart Labs ("we", "us", "our"), based in Dublin, Ohio, United States.

By accessing the site or submitting an inquiry through it, you agree to these Terms. If you do not agree, please do not use the site.

Using the site

You may browse the site for informational purposes and contact us through the forms provided. You agree not to:

Actual price and schedule depend on scope, content readiness, the number of revisions, third-party dependencies, and how quickly we receive what we need from you.

Nothing on this site is a binding quote, and no contract is formed by browsing the site or submitting a form. A project begins only when both parties sign a written proposal or Statement of Work, which will state the actual scope, fees, schedule, and terms for that engagement.

Project engagements

Client work is governed by the signed proposal or Statement of Work for that project. Where that document conflicts with these Terms, that document controls for the engagement it covers. These Terms continue to govern your general use of the site.

Intellectual property

The site and its contents — copy, design, code, graphics, and the Made by Velocity and QStart Labs names and logos — are owned by QStart Labs or its licensors and are protected by intellectual property laws. You may view and print pages for your own reference and link to the site freely. You may not copy, republish, or create derivative works from substantial portions of the site without our written permission.

Work delivered under a client engagement is licensed or assigned according to that engagement's written agreement, not these Terms.

Portfolio and client work

Projects shown on this site are presented with the permission of the clients concerned. Client names, logos, and screenshots remain the property of their respective owners and are used to identify the work shown. Screenshots reflect a site as it appeared when captured; the live site may since have changed.

What you send us

You are responsible for the accuracy of information you submit and for having the right to share it. By sending us a message or project brief, you grant us permission to use that information to evaluate and respond to your inquiry and, if we work together, to deliver the project. If you send us unsolicited ideas or suggestions, we may use them without obligation or compensation to you.

Third-party links and services

The site links to third-party websites and uses third-party services such as scheduling and analytics. We do not control those sites and services and are not responsible for their content, availability, or practices. Your use of them is governed by their own terms.

Disclaimers

Indemnification

You agree to indemnify and hold harmless QStart Labs from any claims, losses, liabilities, and reasonable legal fees arising out of your misuse of the site, your violation of these Terms, or your violation of the rights of another.

Changes to the site and these Terms

We may change, suspend, or discontinue any part of the site at any time. We may also update these Terms; when we do, we will revise the "Last updated" date above. Changes apply going forward, and your continued use of the site after an update means you accept the revised Terms.

Governing law and venue

These Terms are governed by the laws of the State of Ohio, United States, without regard to its conflict of laws rules. You agree that the state and federal courts located in Franklin County, Ohio have exclusive jurisdiction over any dispute arising from these Terms or the site, and you consent to venue there.

Severability and entire agreement

If any provision of these Terms is found unenforceable, that provision will be limited or removed to the minimum extent necessary and the remaining provisions stay in full effect. Our failure to enforce a provision is not a waiver of it. These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding your use of the site.
